If there are differences between this page and the faculty handbook, please reach out to the Office of the Associate VP for Academic Affairs.<\/span><\/p>\n<\/div>\n\t\t<\/div><\/div><\/div><\/div><div id=\"pg-171-1\"  class=\"panel-grid panel-has-style\" ><div class=\"panel-row-style panel-row-style-for-171-1\" ><div id=\"pgc-171-1-0\"  class=\"panel-grid-cell\" ><div id=\"panel-171-1-0-0\" class=\"so-panel widget widget_smcm-title panel-first-child\" data-index=\"1\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-smcm-title so-widget-smcm-title-base\"\n\t\t\t\n\t\t><h2 class=\"smcm-section-title navy\" style=\"\"><strong><\/strong>Academic<strong><\/strong> <strong><\/strong>Misconduct<strong><\/strong><\/h2><\/div><\/div><div id=\"panel-171-1-0-1\" class=\"so-panel widget widget_text\" data-index=\"2\" >\t\t\t<div class=\"textwidget\"><p>\u201cAll students are expected to uphold the highest ideals of academic integrity throughout their career at St. Mary\u2019s\u201d (Article III, Judicial Procedures for Academic Misconduct, \u201cThe Student Code and Student Rights and Responsibilities,\u201d <em>To the Point<\/em>).<\/p>\n<p>The Office of the Associate Vice President for Academic Affairs (AVPAA) is responsible for upholding the <a href=\"https:\/\/www.smcm.edu\/tothepoint\/academic-misconduct\/\">Judicial Procedures for Academic Misconduct<\/a>, which is included in the <a href=\"https:\/\/www.smcm.edu\/tothepoint\/academic-misconduct\/\">Student Handbook, <em>To the Point<\/em><\/a>. The AVPAA collaborates with the Academic Judicial Board (AJB) if a hearing is required for a particular situation.<\/p>\n<\/div>\n\t\t<\/div><div id=\"panel-171-1-0-2\" class=\"so-panel widget widget_smcm-accordion\" data-index=\"3\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-smcm-accordion so-widget-smcm-accordion-base\"\n\t\t\t\n\t\t><div class=\"smcm-accordion  navy\"><div class=\"title-container\"><h3>When do I need to report academic misconduct?<\/h3><i class=\"fa-solid fa-plus open-close\" ><\/i><\/div><div class=\"smcm-accordion-content\"> <div class=\"smcm-ac-content-wrapper\"><p>The Judicial Procedures for Academic Misconduct outline the four principle types of misconduct, though other types of misconduct may be reported. Incidents should be reported when documentation offers \"a preponderance of evidence;\" a \u2018hunch\u2019 or \u2018strong suspicion\u2019 is likely insufficient for officially reporting the incident to the Office of the APVAA.When in doubt, instructors should consult with the AVPAA.<\/p>\n<p>While faculty are obliged to report any cases of misconduct, there is considerable leeway in addressing the incident. <strong>An in-course penalty may range from a verbal warning to failing the course.<\/strong> For more complex matters (multiple students involved in cheating, a strongly-contested incident for which the instructor feels certain the student is responsible), the instructor may opt to request a hearing by the Academic Judicial Board (AJB). The decision to call the hearing is at the discretion of the AVPAA.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div id=\"panel-171-1-0-3\" class=\"so-panel widget widget_smcm-accordion\" data-index=\"4\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-smcm-accordion so-widget-smcm-accordion-base\"\n\t\t\t\n\t\t><div class=\"smcm-accordion  navy\"><div class=\"title-container\"><h3>How Do Faculty Report Misconduct?<\/h3><i class=\"fa-solid fa-plus open-close\" ><\/i><\/div><div class=\"smcm-accordion-content\"> <div class=\"smcm-ac-content-wrapper\"><p><strong>As of Fall 2025, reports are<\/strong> <a href=\"https:\/\/cm.maxient.com\/reportingform.php?StMarysMD&amp;layout_id=31\">submitted directly to the Maxient portal<\/a>. The questions at the Maxient portal directly mirror what has previously been used on the paper form.<\/p>\n<p>Attachments up to 5GB can be included in the submission, though it may take a while to fully upload. <strong>Important:<\/strong> At the bottom of the form, <strong><em>before you click submit<\/em><\/strong>, verify that the small box \"Email me a copy of this form\" is already selected. (check the box if not). You will then receive copy of your answers to then share with the student (this becomes the \"copy\" of the original submission form instructors gave in the manual method). Any materials used to document the misconduct can also be given to the student electronically.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div id=\"panel-171-1-0-4\" class=\"so-panel widget widget_smcm-accordion\" data-index=\"5\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-smcm-accordion so-widget-smcm-accordion-base\"\n\t\t\t\n\t\t><div class=\"smcm-accordion  navy\"><div class=\"title-container\"><h3>What is the Instructor\u2019s Purview?<\/h3><i class=\"fa-solid fa-plus open-close\" ><\/i><\/div><div class=\"smcm-accordion-content\"> <div class=\"smcm-ac-content-wrapper\"><p>It\u2019s the instructor's prerogative to initially decide the following, to be noted on the incident report:<\/p>\n<ul>\n<li>whether this constitutes minor or major academic misconduct (note this is a fairly subjective discernment, and does not have a direct bearing on how possible sanctions will be applied);<\/li>\n<li>whether to treat the incident as an \"in-course penalty\" (sanctions determined by the instructor and only applicable within the course) or to request an AJB hearing (finding of \"responsible\/not responsible\" determined by AJB)\n<ul>\n<li>NB: regardless of the instructor's request to apply an in-course penalty, if the student is found to have previous academic misconduct on file, the incident will automatically be forwarded to the AJB for a hearing.<\/li>\n<\/ul>\n<\/li>\n<li>a *recommended* sanction.\u00a0 The AJB or the Associate Vice President for Academic Affairs may opt to diverge from the faculty member's recommended sanction for the following reasons:\n<ul>\n<li>if the student is found not responsible by the AJB, all records of the incident will automatically be deleted from college records.<\/li>\n<li>if the proposed sanction is deemed to be out of alignment with the violation, the AJB may recommend a more suitable penalty. The Associate Vice President will discuss this with the instructor to find an appropriate compromise.<\/li>\n<li>if the student has been found responsible in previous incidents of academic misconduct. If, in the present case, the AJB finds the student responsible, the Office of the Associate Vice President will inform the AJB of any previous sanctions for misconduct in incidents for which they have been held responsible.\u00a0 In those situations, the AJB may suggest more stringent sanctions than what had been suggested by the instructor.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div><\/div><\/div><\/div><\/div><div id=\"panel-171-1-0-5\" class=\"so-panel widget widget_smcm-accordion\" data-index=\"6\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-smcm-accordion so-widget-smcm-accordion-base\"\n\t\t\t\n\t\t><div class=\"smcm-accordion  navy\"><div class=\"title-container\"><h3>Who Can Faculty Consult for Advice \/ Feedback? <\/h3><i class=\"fa-solid fa-plus open-close\" ><\/i><\/div><div class=\"smcm-accordion-content\"> <div class=\"smcm-ac-content-wrapper\"><p><strong>IMPORTANT:<\/strong> this is a rare incident in which FERPA does *not* cover our internal college rules of \"Legitimate Educational Interest.\" That is, <em>information regarding the names of those involved in cases of academic misconduct may not be divulged to other instructors, to the student's academic advisor or coach, to the department chair, or anyone not immediately involved in the incident OTHER THAN the Associate Vice President for Academic Affairs and, via the Associate Vice President for Academic Affairs, the members of the AJB.<\/em> Colleagues are free to discuss the circumstances of a possible violation for the purposes of seeking advice as long as no identifying information is exchanged.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div id=\"panel-171-1-0-6\" class=\"so-panel widget widget_smcm-accordion panel-last-child\" data-index=\"7\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-smcm-accordion so-widget-smcm-accordion-base\"\n\t\t\t\n\t\t><div class=\"smcm-accordion  navy\"><div class=\"title-container\"><h3>How are misconduct incidents recorded, and are they reported to outside parties?<\/h3><i class=\"fa-solid fa-plus open-close\" ><\/i><\/div><div class=\"smcm-accordion-content\"> <div class=\"smcm-ac-content-wrapper\"><p>Per the processes outlined in the <a href=\"https:\/\/www.smcm.edu\/tothepoint\/academic-misconduct\/\">Student Handbook<\/a>, the Office of the AVP maintains the records for seven years from the time of the incident.<\/p>\n<p>Should the College receive an external request for a reference check of a student\u2019s academic conduct, these queries should be directed to the Associate Vice President for Academic Affairs.\u00a0 Such requests include but are not limited to applications for graduate programs and background checks as a condition of employment for security-sensitive work, and are made with the knowledge of the SMCM alumnus. For the purposes of external reporting, <strong>the College makes a distinction between <em>educational<\/em> and <em>disciplinary<\/em> sanctions<\/strong> in the AJB process, and <strong>will report only the occurrence of <em>disciplinary<\/em> sanctions<\/strong> to employers and institutions conducting reference checks.<\/p>\n<ul>\n<li>An educational sanction is any in-course sanction up to but not including an \u201cF\u201d in the course.<\/li>\n<li>All other sanctions are considered disciplinary sanctions and therefore part of the student\u2019s official academic record.<\/li>\n<\/ul>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/div><div id=\"pg-171-2\"  class=\"panel-grid panel-no-style\" ><div id=\"pgc-171-2-0\"  class=\"panel-grid-cell\" ><div id=\"panel-171-2-0-0\" class=\"so-panel widget widget_smcm-title panel-first-child\" data-index=\"8\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-smcm-title so-widget-smcm-title-base\"\n\t\t\t\n\t\t><h2 class=\"smcm-section-title navy\" style=\"\"><strong><\/strong>All<strong><\/strong> <strong><\/strong>Faculty<strong><\/strong> <strong><\/strong>Email<strong><\/strong><\/h2><\/div><\/div><div id=\"panel-171-2-0-1\" class=\"so-panel widget widget_text\" data-index=\"9\" >\t\t\t<div class=\"textwidget\"><p><span style=\"font-weight: 400;\">All Faculty Email, <\/span><span style=\"font-weight: 400;\"><a href=\"mailto:allfacultymail@smcm.edu\">allfacultymail@smcm.edu<\/a>,<\/span><span style=\"font-weight: 400;\">\u00a0is an email listserv that includes all faculty (with SMCM emails) with the sole purpose of distributing academic affairs related information. <\/span><\/p>\n<\/div>\n\t\t<\/div><div id=\"panel-171-2-0-2\" class=\"so-panel widget widget_smcm-accordion\" data-index=\"10\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-smcm-accordion so-widget-smcm-accordion-base\"\n\t\t\t\n\t\t><div class=\"smcm-accordion  navy\"><div class=\"title-container\"><h3>Who can send emails using this?<\/h3><i class=\"fa-solid fa-plus open-close\" ><\/i><\/div><div class=\"smcm-accordion-content\"> <div class=\"smcm-ac-content-wrapper\"><p>Select SMCM administrators.\u00a0 Within Academic Affairs, this includes the VPAA\/Dean of Faculty, Executive Assistant to the VPAA and the Associate Vice President for Academic Affairs<\/p>\n<\/div><\/div><\/div><\/div><\/div><div id=\"panel-171-2-0-3\" class=\"so-panel widget widget_smcm-accordion\" data-index=\"11\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-smcm-accordion so-widget-smcm-accordion-base\"\n\t\t\t\n\t\t><div class=\"smcm-accordion  navy\"><div class=\"title-container\"><h3>How can I get added to the listserv?<\/h3><i class=\"fa-solid fa-plus open-close\" ><\/i><\/div><div class=\"smcm-accordion-content\"> <div class=\"smcm-ac-content-wrapper\"><p>Contact OIT.
