{"id":341,"date":"2024-09-04T19:19:23","date_gmt":"2024-09-04T19:19:23","guid":{"rendered":"https:\/\/www.smcm.edu\/tothepoint-2024\/?page_id=341"},"modified":"2024-10-17T19:18:58","modified_gmt":"2024-10-17T19:18:58","slug":"academic-grievance-policy","status":"publish","type":"page","link":"https:\/\/www.smcm.edu\/tothepoint\/academic-grievance-policy\/","title":{"rendered":"Academic Grievance Policy"},"content":{"rendered":"<p><b>Procedures to address student complaints about faculty\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">If a student has significant concerns or complaints about a faculty member, the following<\/span> <span style=\"font-weight: 400;\">procedure should be followed.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">NB: this procedure is to be used as a last resort after normal efforts to discuss and resolve<\/span> <span style=\"font-weight: 400;\">concerns with the instructor have not proven effective. These steps are neither intended nor<\/span> <span style=\"font-weight: 400;\">appropriate for complaints regarding the instructor\u2019s personality or delivery (e.g., \u201cthe instructor<\/span> <span style=\"font-weight: 400;\">isn\u2019t interesting\u201d) or the student\u2019s learning preferences (e.g., too much reading; grading is too<\/span> <span style=\"font-weight: 400;\">difficult; course doesn\u2019t use Blackboard).<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Rather, complaints brought forward may include but are not limited to matters that relate to<\/span> <span style=\"font-weight: 400;\">fundamental fairness or the student\u2019s ability to be successful in the course as defined by the<\/span> <span style=\"font-weight: 400;\">syllabus. If there are questions about the applicability of the student complaint procedures, the<\/span> <span style=\"font-weight: 400;\">student is encouraged to consult with the Office of Associate Deans of Faculty to discuss.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<ol type=\"I\">\n<li><span style=\"font-weight: 400;\"> If the student complaint involves matters of gender bias or sexual harassment, sexual<\/span> <span style=\"font-weight: 400;\">violence, stalking, or intimate partner violence, the student is encouraged to make a<\/span> <span style=\"font-weight: 400;\">report directly to the Title IX Coordinator, Deputy Title IX Coordinator, the Dean of<\/span> <span style=\"font-weight: 400;\">Students Office, Public Safety or the Office of Student Conduct. Complaints involving<\/span> <span style=\"font-weight: 400;\">College employees, volunteers or contractors can also be made to the College\u2019s AA\/EEO<\/span> <span style=\"font-weight: 400;\">Officer.<\/span>\n<ol type=\"a\">\n<li>In addition to and separate from the student\u2019s report, responsible employees \u2013 including faculty, coaches, administrators, Public Safety, and student employees or volunteers with a significant responsibility for student welfare \u2013 are required to report any knowledge of alleged sexual misconduct to the Office of Title IX.<\/li>\n<\/ol>\n<\/li>\n<li><span style=\"font-weight: 400;\"> If the student complaint involves matters of bias, the student is encouraged to make a<\/span> <span style=\"font-weight: 400;\">bias incident report directly to the<\/span> <span style=\"font-weight: 400;\">Bias Prevention and Support Team<\/span><span style=\"font-weight: 400;\">.<\/span> <b>Bias-related<\/b> <b>incidents <\/b><span style=\"font-weight: 400;\">are acts that demonstrate bias on the basis of race, color, religion, sex,<\/span> <span style=\"font-weight: 400;\">national origin, gender identity or expression, sexual orientation, ethnicity, age, marital<\/span> <span style=\"font-weight: 400;\">status, physical or mental disability, protected veteran status, or any other<\/span> <span style=\"font-weight: 400;\">characteristic protected by law. As defined here, bias-related incidents are ones that<\/span> <span style=\"font-weight: 400;\">do not rise to the level of discrimination or harassment prohibited by law (such as Title<\/span> <span style=\"font-weight: 400;\">IX sexual harassment, Title VI or Title VII discrimination on the basis of race,<\/span> <span style=\"font-weight: 400;\">ability-based discrimination under the Americans with Disabilities Act, and others). In<\/span> <span style=\"font-weight: 400;\">many cases, the determination of whether a bias-related incident will be addressed by<\/span> <span style=\"font-weight: 400;\">the Bias Prevention and Support Team or another College office or official will be<\/span> <span style=\"font-weight: 400;\">based on the severity and\/or pervasiveness of the reported conduct, as determined<\/span> <span style=\"font-weight: 400;\">by a reasonable person.<\/span><\/li>\n<li>If the student complaint involves specific academic policies such as a grade grievance or the desire to appeal a claim of academic misconduct, the student should follow the procedures defined for those purposes in the Student Handbook. The student may also consult the Office of the Associate Deans of Faculty with any questions.<\/li>\n<li>If the student complaint falls outside the above three categories and instead involves more general issues of interpersonal conflict, classroom management, or other pedagogical concerns, the student should pursue the steps below.<\/li>\n<\/ol>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"list-style-type: none;\">\n<ol type=\"A\">\n<li><span style=\"font-weight: 400;\"> Note that the window for a student to pursue a complaint is time-limited; a<\/span> <span style=\"font-weight: 400;\">complaint may be filed no later than Friday, 5:00pm of the fourth week into the<\/span> <span style=\"font-weight: 400;\">subsequent semester.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> To the degree in which the student is comfortable doing so, the student is<\/span> <span style=\"font-weight: 400;\">encouraged to first attempt to discuss and resolve the matter unofficially with the<\/span> <span style=\"font-weight: 400;\">instructor. In the case of a satisfactory resolution, both parties are encouraged to<\/span> <span style=\"font-weight: 400;\">summarize this resolution in a shared email in the event it should later be useful.<\/span><\/li>\n<li>If the student is uncomfortable having that conversation, if the student believes there is bullying or intimidating behavior on the part of the instructor, or if the matter is not resolved by way of discussion, the student may advance the complaint to the department chair for consideration and resolution, known as \u201can assessment.\u201d\n<ol>\n<li><span style=\"font-weight: 400;\"> The department chair should respect the student\u2019s confidentiality if so<\/span> <span style=\"font-weight: 400;\">requested; however, the student should be made aware that this may limit<\/span> <span style=\"font-weight: 400;\">the chair\u2019s ability to fully investigate the issue.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> The student should also be made aware that the instructor will be notified<\/span> <span style=\"font-weight: 400;\">of the existence of a student complaint once the chair begins the <\/span>assessment.<\/li>\n<li>The assessment will likely involve separate discussions with the instructor and with the student, plus a review of any related course materials. This should be completed within two weeks (14 calendar days) of the student\u2019s filing, unless otherwise negotiated with Academic Affairs (both parties should recognize that challenges in arranging discussions may necessarily extend that timeline, although failure of either party to respond to requests for meetings will not prevent the chair from moving forward with the investigation in a timely manner). The chair should summarize findings in a letter and propose a course of action, redacting the student\u2019s name if confidentiality has been requested.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"list-style-type: none;\">\n<ol type=\"a\">\n<li><span style=\"font-weight: 400;\">The unredacted letter and any related documentation should be <\/span>forwarded to the office of the Associate Deans for future reference.<\/li>\n<li><span style=\"font-weight: 400;\">The final letter (redacted version, if the student has requested <\/span>confidentiality) and any related documentation should be shared with the student and faculty member. Each party should have the ability to respond within 7 calendar days.\n<ol type=\"1\">\n<li><span style=\"font-weight: 400;\">Any response should likewise be forwarded to the office of<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">the Associate Deans for future reference.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u00a0The chair should retain a copy of all documentation for<\/span> <span style=\"font-weight: 400;\">reference during the course of the chair\u2019s term of service;<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">however, the letter and documents should not be discussed<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">with other department members or passed on to<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">subsequent chairs. It is incumbent upon the chair to<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">maintain the confidentiality of both the student and faculty<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">member during and after the process.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<\/ol>\n<\/li>\n<li><span style=\"font-weight: 400;\">If either party is not satisfied with the outcome, or if the course of<\/span> <span style=\"font-weight: 400;\">action does not alter behavior, either party or the chair may <\/span>advance the grievance to the instructor\u2019s Associate Dean of Faculty.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"list-style-type: none;\">\n<ol start=\"4\" type=\"A\">\n<li><span style=\"font-weight: 400;\">If the complaint involves the chair, or if the matter is not resolved satisfactorily<\/span> <span style=\"font-weight: 400;\">through the chair, the student may bring the complaint to the chair\u2019s Associate<\/span> <span style=\"font-weight: 400;\">Dean of Faculty.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span>\n<ol>\n<li><span style=\"font-weight: 400;\">The Associate Dean should respect the student\u2019s confidentiality if so<\/span> <span style=\"font-weight: 400;\">requested; however, the student should be made aware that this may limit<\/span> <span style=\"font-weight: 400;\">the Associate Dean\u2019s ability to fully investigate the issue.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> The student should also be made aware that the instructor will be notified<\/span> <span style=\"font-weight: 400;\">once the Associate Dean begins the formal assessment of the complaint.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> The assessment will likely involve discussions with the instructor and with<\/span> <span style=\"font-weight: 400;\">the student, plus a review of any related course materials. This should be<\/span> <span style=\"font-weight: 400;\">completed in a timely manner, ideally within 14 calendar days of the<\/span> <span style=\"font-weight: 400;\">student\u2019s complaint (both parties should recognize that challenges in<\/span> <span style=\"font-weight: 400;\">arranging discussions may necessarily extend that timeline, although<\/span> <span style=\"font-weight: 400;\">failure of either party to respond to requests for meetings will not prevent<\/span> <span style=\"font-weight: 400;\">the Associate Dean from moving forward with the investigation in a timely<\/span> <span style=\"font-weight: 400;\">manner).<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> The Associate Dean should summarize findings in a letter and propose a<\/span> <span style=\"font-weight: 400;\">course of action, redacting the student\u2019s name if confidentiality has been<\/span> <span style=\"font-weight: 400;\">requested, <\/span><span style=\"font-weight: 400;\">and retain the documentation for future reference.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The unredacted letter of the Associate Dean and any related <\/span>documentation should be retained with the associated materials on file.<\/li>\n<li><span style=\"font-weight: 400;\">The final letter (redacted version, if the student has requested<\/span> <span style=\"font-weight: 400;\">confidentiality) and any related documentation should be shared with the<\/span> <span style=\"font-weight: 400;\">student and faculty member. Each party should have the ability to respond<\/span> <span style=\"font-weight: 400;\">within 7 calendar days.<\/span>\n<ol type=\"a\">\n<li><span style=\"font-weight: 400;\">Any response should likewise be forwarded to the office of the<\/span> <span style=\"font-weight: 400;\">Associate Dean for future reference.<\/span><\/li>\n<\/ol>\n<\/li>\n<li><span style=\"font-weight: 400;\">If either party is not satisfied with the outcome, or if the course of action<\/span> <span style=\"font-weight: 400;\">does not alter behavior, either party or administrator may advance the <\/span>grievance to the Dean of Faculty for an appeal. All reasonable efforts will be made for the Dean of Faculty to respond to the appeal within 10 business days. The Dean of Faculty will have final jurisdiction over the outcome.<\/li>\n<li><span style=\"font-weight: 400;\">Upon the resolution of the complaint, electronic copies (unredacted) of all<\/span> <span style=\"font-weight: 400;\">assessment letters and associated materials should be forwarded to the<\/span> <span style=\"font-weight: 400;\">Office of the Associate Dean of Faculty for the sole purposes of <\/span>institutional documentation in the event that similar student complaints should later arise, or should the complainant pursue further redress.<\/li>\n<li><span style=\"font-weight: 400;\"> The findings of all assessments may be appealed through the Dean of Faculty,<\/span> <span style=\"font-weight: 400;\">who will make the final ruling.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> The summary of the assessment(s) and the outcome(s) of any student complaints<\/span> <span style=\"font-weight: 400;\">should be summarized in writing by the assessor and forwarded to the instructor,<\/span> <span style=\"font-weight: 400;\">chair, and student.<\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>Procedures to address student complaints about faculty\u00a0 If a student has significant concerns or complaints about a faculty member, the following procedure should be followed.\u00a0 NB: this procedure is to be used as a last resort after normal efforts to discuss and resolve concerns with the instructor have not proven effective.
