The Office of Public Safety is responsible for writing the content of the Timely\u00a0Warning Notice and <em>distributing it to the campus community.\u00a0<\/em>Approval\u200c \u200cfor\u200c \u200cdissemination\u200c \u200cfrom\u200c \u200cother\u200c \u200ccampus\u200c \u200cdepartments\u200c \u200cis\u200c\u00a0\u200cnot\u200c \u200crequired.\u200c\u00a0\u200c<\/p>\n<h2 >Definitions<\/h2>\n<ol type=\"A\">\n<li><em>Timely Warning: <\/em>The Clery Act requires all colleges and universities to alert the campus community to certain crimes that\u00a0may represent an ongoing threat to the safety of students or employees in a manner that is timely and will aid in the prevention of similar crimes.<\/li>\n<li><em>Clery Reportable Crimes<\/em>: Crimes that are reported to Campus Security Authorities and are committed on college reportable\u00a0geography.\n<ol type=\"a\">\n<li>Clery reportable crimes are:\n<ol type=\"i\">\n<li>Criminal Homicide, including Murder, including Murder, Non-negligent Manslaughter and Manslaughter by Negligence; Sexual Assault, including Rape, Fondling, Incest and Statutory Rape; Robbery; Aggravated Assault; Burglary; Motor Vehicle Theft; and Arson. Sexual\u00a0Assault, including Rape, Fondling, Incest and Statutory Rape;<\/li>\n<li>Robbery;<\/li>\n<li>Aggravated Assault;<\/li>\n<li>Burglary;<\/li>\n<li>Motor Vehicle Theft; and<\/li>\n<li>Arson.<\/li>\n<\/ol>\n<\/li>\n<li>Hate Crimes include any of the above-mentioned criminal offenses and any incidents of\n<ol type=\"i\">\n<li>Larceny-Theft, Simple\u00a0Assault, Intimidation, or Destruction \/ Damage \/ Vandalism of Property that were motivated by bias.<\/li>\n<li>Violence Against Women Act (VAWA) Offenses include incidents of Domestic Violence, Dating Violence and\u00a0Stalking; and<\/li>\n<li>Arrests and Referrals for Weapons Law, Liquor Law and Drug Law violations.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<li>Hazing: Any act which meets the definition of hazing under Federal, State, Local law and\/or College Policy.<\/li>\n<li><em>Other Serious Crime<\/em>: The College, in its discretion, may issue timely warnings for other crimes it deems pose an ongoing\u00a0threat to the safety of students or employees, regardless of whether it is a Clery Reportable Crime.<\/li>\n<li><strong>\u200c<em>Campus\u200c \u200cReportable\u200c \u200cGeography<\/em><\/strong><em>:\u200c<\/em>Any\u200c \u200cproperties\u200c \u200cowned\u200c \u200cor\u200c \u200ccontrolled\u200c \u200cby\u200c \u200cthe\u200c \u200ccollege\u200c\u00a0\u200cor\u200c \u200cany\u200c \u200cpublic\u200c \u200cproperty\u200c \u200cadjacent\u200c \u200cto\u200c \u200cand\u200c \u200caccessible\u200c\u00a0\u200cfrom\u200c \u200cthe\u200c \u200ccampus.\u200c Crimes\u200c \u200cthat\u200c \u200coccur\u200c \u200coutside\u200c \u200cof\u200c \u200cthe\u200c\u00a0\u200cClery\u200c \u200creportable\u200c \u200cgeography\u200c \u200cof\u200c \u200cthe\u200c \u200ccollege\u200c \u200cmay\u200c \u200cbe\u200c\u00a0\u200cconsidered\u200c \u200cfor\u200c \u200ca\u200c \u200ctimely\u200c \u200cwarning\u200c \u200cif\u200c \u200cthey\u200c \u200cmay\u200c \u200cpose\u200c \u200ca\u200c\u00a0\u200c\u00a0serious\u200c \u200cor\u200c \u200congoing\u200c \u200cthreat\u200c \u200cto\u200c \u200cthe\u200c \u200ccampus\u200c\u00a0\u200ccommunity.\u200c\u00a0\u200c<\/li>\n<li><em>Campus Security Authority<\/em>: A Clery Act specific term that encompasses four groups of individuals and organizations\u00a0associated with an institution:\n<ol type=\"a\">\n<li>A campus police department or a campus security department.<\/li>\n<li>Any individual or individuals who have responsibility for campus security but who do not constitute a campus\u00a0police department or a campus security department.<\/li>\n<li>Any individual or organization specified in an institution\u2019s statement of campus security policy as an individual or\u00a0organization to which students and employees should report criminal offenses.<\/li>\n<li>An official of an institution who has significant responsibility for student and campus activities.<\/li>\n<\/ol>\n<\/li>\n<li><strong><em>Pastoral\u200c \u200cor\u200c \u200cProfessional\u200c \u200cCounselor<\/em><\/strong><em>:\u200c <\/em>When\u200c \u200cacting\u200c \u200cwithin\u200c \u200cthe\u200c \u200cscope\u200c \u200cof\u200c \u200ctheir\u200c \u200cemployment professional\u200c \u200cand\u200c \u200cpastoral\u200c \u200ccounselors\u200c \u200care\u200c \u200cnot\u200c\u00a0\u200cconsidered\u200c \u200cto\u200c \u200cbe\u200c \u200cCampus\u200c \u200cSecurity Authorities\u200c \u200cand\u200c\u00a0\u200care\u200c \u200cnot\u200c \u200crequired\u200c \u200cto\u200c \u200creport\u200c \u200ccrimes.\u200c Therefore\u200c\u00a0\u200creports\u200c \u200cto\u200c \u200cprofessional\u200c \u200cor\u200c \u200cpastoral\u200c \u200ccounselors\u200c \u200cmay\u200c\u00a0\u200cnot\u200c \u200cresult\u200c \u200cin\u200c \u200cthe\u200c \u200cissuance\u200c \u200cof\u200c \u200ca\u200c \u200ctimely\u200c \u200cwarning.\u200c\u00a0\u200c<\/li>\n<\/ol>\n<h2 >Procedure<\/h2>\n<ol type=\"i\">\n<li ><em> Decision to Issue\u00a0<\/em>\n<ol type=\"A\">\n<li>All decisions on whether or not a Timely Warning is issued shall be made on a case-by-case basis, considering the facts surrounding a crime including:\n<ol type=\"a\">\n<li>The nature of the crime.<\/li>\n<li>The continuing danger or threat to the campus community.<\/li>\n<li>The amount of time that has elapsed between the occurrence and report.<\/li>\n<li>Whether the identity of the offender(s) is known.<\/li>\n<li>The possible risk of compromising law enforcement efforts.<\/li>\n<\/ol>\n<\/li>\n<li>The decision shall be made by the Director of Public Safety or his\/her designee.<\/li>\n<li>A Timely Warning will be issued as soon as pertinent information is available and within a reasonable\u00a0amount of time.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ol start=\"2\" type=\"i\">\n<li><em> Determining the Content of the Timely Warning\u00a0<\/em>\n<ol type=\"A\">\n<li>The content of the timely warning is intended to enable members of the campus community to protect\u00a0themselves, and may include, but will not necessarily be limited to:\n<ol type=\"a\">\n<li>A succinct statement of the incident including the date, time, general location and nature of the reported crime(s);<\/li>\n<li>Possible connection to previous incidents;<\/li>\n<li>A physical description of the suspect(s);<\/li>\n<li>A photo or composite drawing of the suspect(s);<\/li>\n<li>Other relevant and important information about the crime(s);<\/li>\n<li>Actions taken by the Office of Public Safety and\/or law enforcement officials in response to the crime(s);<\/li>\n<li>Information on crime prevention, personal safety or other community safety resources; and viii. How to contact the Office of Public Safety regarding the crime(s).<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<h2 >Dissemination of Timely Warnings<\/h2>\n<ol type=\"A\">\n<li>The following methods may be utilized to distribute Timely Warnings\n<ol type=\"a\">\n<li>Official College email<\/li>\n<li>Flyers posted in buildings<\/li>\n<li>Public Safety Website<\/li>\n<li>Campus Shield<\/li>\n<\/ol>\n<\/li>\n<li>The\u200c \u200cCollege\u200c \u200cwill\u200c \u200cnotify\u200c \u200cthe\u200c \u200clarger\u200c \u200ccommunity\u200c \u200cif\/when\u200c \u200cnecessary\u200c \u200cthrough\u200c \u200cthe\u200c \u200clocal\u200c \u200cmedia\u200c \u200coutlets\u200c \u200cworking\u200c \u200cwith\u200c \u200cthe\u200c \u200cCollege\u200c \u200cOffice\u200c \u200cof\u200c \u200cAdvancement\u200c \u200cand\u200c \u200clocal\u200c \u200cpublic\u200c \u200csafety\u200c \u200cagencies.\u200c<\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>Purpose The purpose of this directive is to provide clear guidelines for the issuance of Timely Warnings in accordance with the\u00a0Jeanne Clery Act (Clery Act).
